Terms of Service

These Terms of Service ("Terms") govern your access to and use of the GateLynk platform and services (the "Service") provided by Global Glory Holdings Proprietary Limited ("we", "us", "our", or the "Company"). By creating an account, subscribing to a plan, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Description of service

GateLynk is a child protection, school safety, and pickup verification platform designed for schools and educational institutions. The Service includes tools for student check-in/check-out tracking, QR code scanning, pickup authorization, parent notifications, emergency contact management, attendance reporting, and related safety features.

2. Acceptance of terms

By using the Service, you confirm that you have the legal authority to enter into these Terms. If you are using the Service on behalf of a school or organisation, you represent that you have authority to bind that entity. If you are an individual user (e.g., a parent or guardian), you confirm that you are of legal age in your jurisdiction.

3. Account registration and security

You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use or security breach.

4. Acceptable use

You agree not to misuse the Service. Prohibited activities include, but are not limited to:

• Using the Service for any unlawful purpose or in violation of any applicable law.
• Attempting to gain unauthorised access to any part of the Service, other users' accounts, or our systems.
• Interfering with or disrupting the integrity or performance of the Service, including introducing malware, viruses, or other harmful code.
• Scraping, crawling, or otherwise harvesting data from the Service without our written consent.
• Using the Service to send spam, phishing messages, or unsolicited communications.
• Reverse engineering, decompiling, or attempting to extract the source code of the Service.
• Reselling, redistributing, or sublicensing access to the Service without authorisation.

5. Intellectual property

Global Glory Holdings Proprietary Limited retains all ownership rights in and to the Service, including all software, documentation, branding, logos, designs, and content provided by us. These Terms do not grant you any ownership interest in the Service or our intellectual property. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service during your subscription term, solely for your internal school or personal use as applicable.

6. Payment, billing, and subscriptions

GateLynk is offered on a subscription basis. Fees are based on the plan selected and the number of students covered. All payment, billing, tax, subscription management, and refund processing is conducted by our online reseller, Paddle.com. Paddle.com is the Merchant of Record for all our orders and provides all customer service inquiries and handles returns. 7. Service level and warranties

We strive to keep the Service available and functioning correctly, but we do not guarantee uninterrupted, timely, secure, or error-free operation. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

8. Limitation of liability

To the maximum extent permitted by law, Global Glory Holdings Proprietary Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the Service. Our aggregate liability shall be limited to the total amount you paid to use the Service in the 12 months preceding the claim. Nothing in these Terms excludes or limits liability for fraud, death, or personal injury caused by our negligence where such exclusion is prohibited by law.

9. Indemnity

You agree to indemnify and hold harmless Global Glory Holdings Proprietary Limited and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content or data you upload to the Service.

10. Suspension and termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for reasons including but not limited to: material breach of these Terms; non-payment of fees; security risks or fraudulent activity; repeated or serious policy violations; or legal requirements. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including intellectual property rights, limitation of liability, and indemnity.

11. Data on termination

Upon termination of your subscription, we will retain your data for a reasonable period to allow you to export it. After that period, we will securely delete or anonymise your data in accordance with our data retention policies. You are responsible for exporting any data you wish to keep before your account is closed.

12. Governing law and disputes

These Terms shall be governed by and construed in accordance with the laws of the Republic of Botswana, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Botswana.

13. Changes to these terms

We may revise these Terms from time to time. The most current version will always be posted on this page. Material changes will be notified to you via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
